Acceptance of Terms

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Service Description

000form Express provides a fast, simple form backend and submission handling service that allows developers and website owners to collect, manage, and process HTML form submissions without writing server-side code. Features include instant endpoint generation, email notifications, spam filtering, submission storage, file uploads, and a built-in chat widget.

You understand and agree that the Service is provided "as is" and "as available," and that we assume no responsibility for the timeliness, deletion, mis-delivery, or failure to store any form submissions, notifications, or personalization settings.

User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, including all form endpoints created and submissions received. You agree to notify us immediately of any unauthorized use of your account.

000form Express Feature

The Express feature allows you to quickly test the service without creating an account. When using Express:

• Your email address is required for verification and notification delivery.
• Submitted form data is stored temporarily for delivery to your inbox.
• You may create unlimited test endpoints through the Express playground.
• To retain submissions beyond the test period, you must create a full account.

User Content

You are solely responsible for all forms, form submissions, files, and any other data you create, collect, or process through the Service ("User Content"). You warrant that you own or have the necessary rights and consents to collect the data you process through the Service, and that doing so complies with all applicable laws and regulations, including data protection and privacy laws.

• Ownership: You retain all ownership rights to your User Content. We do not claim any ownership over your forms, endpoints, or the submissions collected through them.
• License: By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your User Content solely for the purpose of operating and providing the Service to you.
• Responsibility: You are solely responsible for ensuring you have the appropriate consent from your end-users to collect and process their data through our Service.
• We reserve the right to remove any User Content that we believe, in our sole discretion, violates these Terms or is otherwise inappropriate or illegal.

Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. Prohibited uses include, but are not limited to:

• Collecting form submissions that contain illegal, defamatory, obscene, or content infringing on intellectual property rights.
• Using the Service to collect sensitive personal data (such as passwords, payment card numbers, or government ID numbers) without appropriate security measures and user consent.
• Creating form endpoints intended to phish, deceive, or defraud end-users.
• Using the Service to send unsolicited emails, spam, or bulk messages.
• Attempting to gain unauthorized access to any part of the Service or another user's account or data.
• Interfering with or disrupting the proper functioning of the Service or its connected infrastructure.
• Uploading or transmitting malicious code, viruses, or any software designed to disrupt or damage systems.
• Circumventing any rate limits, spam filters, or access controls implemented by the Service.
• Reselling, sublicensing, or otherwise commercializing access to the Service without our prior written consent.
• Violating any applicable local, state, national, or international law or regulation.

Data Handling and Privacy

By using the Service to collect form submissions, you acknowledge that all data transmitted through your form endpoints passes through our servers. You are responsible for informing your end-users about this data processing in your own privacy policy. Our handling of any personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

You must not use 000form Express endpoints in contexts that require HIPAA, PCI-DSS, or similar regulated compliance standards unless you have entered into a separate written agreement with us covering such use.

Intellectual Property

The Service and its original content, features, and functionality — including but not limited to the dashboard, API, documentation, and branding — are and will remain the exclusive property of 172 Tech and its licensors. Our trademarks, logos, and trade dress may not be used in connection with any product or service without our prior written consent.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service and all associated form endpoints will immediately cease, and we may delete your stored submissions and account data in accordance with our data retention policy.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ALL FORM SUBMISSIONS WILL BE DELIVERED OR STORED WITHOUT LOSS.

Limitation of Liability

In no event shall 000form Express, 172 Tech, ESS ENN Associates, nor their directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to access or use the Service.
• Any loss or corruption of form submission data.
• Any failure to deliver email notifications or webhooks.
• Any conduct or content of any third party on or through the Service.
• Unauthorized access, use, or alteration of your form endpoints, submissions, or account data, whether based on warranty, contract, tort (including negligence), or any other legal theory.

Indemnification

You agree to indemnify and hold harmless 172 Tech, ESS ENN Associates, and their affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, costs, or legal fees arising out of or in any way connected with your violation of these Terms, your use of the Service, the data you collect through your form endpoints, or your violation of any rights of any other person or entity.

Governing Law

These Terms shall be governed and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Chandigarh, India, without regard to conflict of law provisions.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will post revised Terms on the Service and update the "Last Updated" date at the top of this page. For significant changes, we will endeavor to provide at least 30 days' notice before the new terms take effect.

By continuing to access or use our Service after revised Terms become effective, you agree to be bound by the updated Terms.
